I cannot read italian. This http://avvertenze.aduc.it/generale/files/file/allegati/cassazione-rimborso-windows.pdf is an italian court decision about getting a refund for an unused windows license. A consumer managed to get a refund from seller for an unused windows license that came with the computer. Please read the court's decision and tell me if there are any references to law coming from the European Commission or references to statement made by the European Union court? What legal sources does the court use? Are the legal sources laws italian laws only or are they italian laws that implements European Union laws. The latter may be difficult to determine from the court documents alone. A law may look italian but still be an implementation of European Union law.
