Thank you for contacting me about Internet privacy. I appreciate hearing from you on this important issue and am glad to have the opportunity to respond.

On December 2, 2016, the Federal Communications Commission (FCC) adopted a final rule implementing the “statutory requirement that telecommunications carriers protect the confidentiality of customer proprietary information.” The rule requires Internet service providers (ISPs) to receive consumers’ permission before selling their private internet browsing history and other sensitive information.

However, Senator Jeff Flake of Arizona introduced S.J.Res. 34, a joint resolution providing for congressional disapproval of the FCC rule relating to “Protecting the Privacy of Customers of Broadband and Other Telecommunications Services,” on March 7, 2017. On March 23, 2017, this legislation passed the Senate by a vote of 50 to 48, and it passed the House on March 28, 2017 by a vote of 215 to 205. I voted against this resolution. President Trump signed it into law on April 3, 2017.

I voted against this legislation because it will leave consumers without clarity or standards for how their private data and security will be protected. Additionally, the resolution will allow ISPs to no longer use “reasonable measures” to protect consumers’ personal information. I am committed to protecting the privacy of the residents of the Fourth District of Massachusetts, and I will certainly keep your views in mind should other legislation on this issue come before me in the U.S. House of Representatives for a vote.
