There's the "PLEASE DO NOT DISTRIBUTE UNMODIFIED BINARIES" part. Now I'm assuming that's a request and not a legal order or does that apply to the binaries with the non-code assets. (music, sound effects and pixel art)
But if you're interested, there's Gog, itch and an actual cartridge where you could throw some coin at the developer.
According to FSF, the Freedom 2 (the freedom to (re-)distribute original copies) is unconditional. So these software can't be classified as free/libre software.
Besides, they use the smearing word "pirate" to denote sharing. This is ethically unacceptable.
There's a difference between nicely asking and using the arm of the law. I saw a "please". So if they clarified they were nicely asking, would it be free software?
There's an episode of Star Trek where Worf said "If you're ordering me, I'll follow" and picard replied with "I'm begging you".

So it's not possible to reason anything about this because it's unclear what it actually applies to. Does the GPL only apply to the binaries? Only to the music, sound effects and pixel art? Does it apply to none of it (since there isn't actually a license grant anywhere so maybe including it was a mistake)? They need to fix this and say by issuing the actual license grant itself.
