MPEG patents and my distro

Hello. I'm building my own distro. I don't know do I need to include bad Gstreamer plugins. Is it illegal? Is it free?

The only plugins that can cause legal trouble are the "ugly" set.

It's needed for certain formats, like MP3, MPEG-4, Windows Media Player, and Quicktime formats.
