Exporting encryption technology

The US government decided not to prosecute Phil for exporting encryption technology.
Why is that? Sounds kind of dodgy. First thing that came to my mind was that the US government probably knows of a bug in PGP allowing them access. Kind of similar to the bug they knew existed in OpenSSH?
I probably barking up the wrong tree.
