Say I start charging the battery at 10% of charge with the icon already being yellow and near empty. If I start charging now it will stay at the same level (though with a charging icon) indefinitely. The only way to know how much charged it is is looking at the time.
Updating to report about the newest iso (Mar 02, 2013) Mini version with lxde. The battery icon is constant and does not report anything at all. Battery is always shown at 100% full and no colors ever change, no matter how much charge it has. The only ways to track the status is with the ibam CLI tool or the blinking physical LED associated.
Marking to critical because
1) When battery is very low, the LED usually starts to blink a red light. This doesn't happen, and you have to guess when the battery is low.
2) Still happening in today's image

I found this upstream bug which is marked as fixed. An updated panel is required:
