Court denies Facebook's motion to dismiss data center design lawsuit

A Silicon Valley judge last week ruled against Facebook’s motion to dismiss a lawsuit filed by a British data center builder in 2015, alleging that the social network misappropriated its trade secrets. The secrets in question are designs and methods for building modular data centers.
As reported by Yevgeniy Sverdlik of Data Center Knowledge:

BladeRoom, one of the two companies that filed the complaint, claims Facebook and Emerson Electric (whose data center subsidiary Emerson Network Power has since been spun out and renamed as Vertiv), lured it and Bripco (the other plaintiff), into disclosing their designs and methods and then turned around and used them to build a data center in Sweden on their own. The two British companies are accusing Facebook and Emerson of enticing “them to reveal their data center designs and construction methods with promises of acquisition and partnership, only to then copy those designs and methods and pass them off as their own,” according to court documents.

The plaintiffs are also alleging that Facebook disclosed their trade secrets publicly through the Open Compute Project, its open source data center and hardware design initiative.

I assume you are referring to the recent events. I use riseup and I trust them. I like their social contract and respect greatly what they have been doing during all these years. I would not recommend their services to random people but I would recommend them to those leading the right fight.

Their personally encrypted storage is supercool and takes care of the recent issue.

my hushmail story, did I already tell this one?

A while ago I realized I didn't want the free email service provided by my ISP which would be Comcast or CenturyLink.

They set their hooks in me with a great price for Internet and after a year suddenly it cost three times as much. I would switch to the other guy for his great deal for a year and tell all my friends my email address had changed. Now I when I switch the Internet, email remains the same.

They didn't take email security seriously. I was assigned a default user name that was my account's admin user name also based on my name. I could not change the admin user name, so by default any hacker in the world could guess my account's admin name and all they need now is a password. Why make it so easy?

And, I was getting really touchy about all the anonymous shadow dwellers connected to the Internet spying on our every activity and I believed neither Comcast or CenturyLink could be trusted not to data mine my emails and that really *#^**ed me off.

So I looked around and decided I would be willing to pay hushmail for their service. The idea is that my email is stored in an encrypted form and can only be unencrypted with the passphrase that I alone know. It is their promise, also not to read my email (in theory, they can't). If they get hacked, it may be harder for the hackers to actually read my email anyway.

Maybe they aren't the best, but they are a huge improvement over Spycast or LetsseeLink or, no doubt, geemail, hegotsmail and the like.

About the government issue - at this point, I know hushmail would help them if court ordered to get at my email, then my government would find evidence I do in fact exist and like any other citizen have some family and a few friends, oh, and I go to church and like Linux and free software.

Not sure with the current administration how much longer my level of trust in my government should go on, but for now...

I am interested in all your comments whenever the subject comes up as it often does. I'm paid up till the end of the year so I got a while to think about a change.

And it does seem like it's good to have a plan B. Will look at riseup, Posteo and Kolab.

Nickman, if you manage to convince those whom you'll send and receive mail to and from to use gpg to encrypt their mail, then any mail provider that you can use with a mail client. So, you get your friends to install say thunderbird with the enigmail plugin (the easiest way I know of) and to spend 10 minutes to read and learn how to use it.

I have a PROTIP for you, unfortunately: many, if not most, will not spend those 10 minutes. :/

Yeah, which is unfortunate that they won't, btw I don't know if you use Uruk GNU/Linux on another computer, but I saw you were a contributor on there so I wanted to get your thoughts on it, what do you think about it?

I don't contribute code for Uruk. Unfortunately me and programming are like dogs and cats, we run away from each other :)
I just submitted translations and some English corrections.
I like what the two main developers are doing, especially the way they made it easy to compile software on Uruk. I did not try it though (yet) as I have been having a big fixation with Debian Jessie with Xfce for the last 2 years or slightly less. I know a couple of my jabber contacts used/use it and they seem to be very happy with it. Give a try and see.

I'll think about trying it out, I also have a bit of a fixation too on Solus and Dragora once I get flash drives that have enough space on them I'll try each of the distro's I like which right now are Uruk, Solus and Dragora or I may do VM, what is your opinion on virtualization? Is it better than doing a flash drive or external hard drive?

I don't virtualize much. I have a spare old lappy to play with when I feel like I want to. Whatever works best for you is the best for you, mate Nickman. cheers
